1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website located at luxresetcredit.com (the "Site") and the credit repair and credit education services (the "Services") offered by LuxReset Credit Solutions LLC ("LuxReset," "we," "us," or "our"), a limited liability company with its principal place of business at Philadelphia, PA 19103. By accessing the Site, submitting an inquiry, or enrolling in the Services, you ("you," "your," or "Client") agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.

These Terms govern your general use of the Site. If you enroll in our Services, a separate, dated written Client Service Agreement will be provided to and signed by you before any services begin, as required by the Credit Repair Organizations Act, 15 U.S.C. § 1679 et seq. ("CROA"). Where these Terms and your signed Client Service Agreement conflict as to the Services you have purchased, the signed Client Service Agreement controls.

2. Description of Services

LuxReset provides credit repair and credit education services, which may include reviewing your credit reports, identifying items that appear inaccurate, incomplete, unverifiable, or outdated, preparing and submitting disputes on your behalf to consumer reporting agencies and/or furnishers, and providing general credit education resources. LuxReset is a "credit repair organization" as defined by CROA and a "credit services organization" as defined by applicable Pennsylvania law. Our Services are provided subject to the protections and restrictions of those laws.

3. Eligibility

You must be at least 18 years old and a legal resident of the United States to use the Services. By enrolling, you represent that the information you provide to us is true, accurate, and complete.

4. Fees and Payment

Fee amounts, billing frequency, and payment terms applicable to your enrollment are set out in your signed Client Service Agreement. Consistent with CROA and the FTC's Telemarketing Sales Rule, LuxReset does not charge or collect any fee, and will not require or request payment of any money or other valuable consideration, until after the services covered by that fee have been fully performed.

Our current billing model charges fees monthly, in arrears, only for dispute and service work actually completed during the preceding billing period. No fee is charged for any period before that period's work has been performed. We accept payment through Stripe and Apple Pay. You may cancel future billing at any time as described in your Client Service Agreement; cancellation does not entitle you to a refund of fees already earned for work already completed.

5. Your Right to Cancel

You may cancel your Client Service Agreement, without any penalty or obligation, at any time before midnight of the third business day after the date you signed it. To cancel, follow the instructions on, and use, the Notice of Cancellation form provided with your Client Service Agreement. This right to cancel is in addition to, and does not limit, any other cancellation or refund term stated in your Client Service Agreement.

6. No Guarantee of Results

Credit repair results depend on the individual facts in each client's credit history and on the independent decisions of consumer reporting agencies, furnishers, and creditors — none of which LuxReset controls. LuxReset does not guarantee that any specific item will be corrected, updated, or removed from your credit report, that your credit score will increase by any particular amount or at all, or that any specific result will occur within any particular timeframe.

Federal law prohibits credit repair organizations from removing accurate, current, and verifiable negative information from a credit report, and neither LuxReset nor any company can lawfully promise that outcome. Any statistics, examples, or figures referenced on the Site describe results for particular clients under their particular circumstances; individual results vary, and past results do not predict or guarantee your results.

7. Client Responsibilities and Authorization

You agree to: (a) provide accurate and complete information, including identifying information reasonably needed to verify your identity and access your credit reports; (b) promptly forward to us any correspondence you receive from consumer reporting agencies, furnishers, or creditors relating to disputes filed on your behalf; and (c) authorize LuxReset and its designated service providers to access your credit report and credit monitoring data solely for the purpose of providing the Services.

You will not ask us, and we will not agree, to help you submit false or misleading information to any consumer reporting agency or creditor, or to alter your identity to conceal accurate credit history, as such conduct is prohibited by CROA.

8. Third-Party Services

We use third-party providers to deliver parts of the Services, including dispute-management platforms (currently DisputeFox and DisputeForMe), credit monitoring and report providers (SmartCredit and IdentityIQ), and payment processors (Stripe and Apple Pay). These providers are independent companies with their own terms of service and privacy practices, which we encourage you to review. LuxReset is not responsible for the acts, omissions, availability, or security practices of independent third-party providers, although we select providers we believe handle client data responsibly.

9. Website Use and Intellectual Property

All content on the Site, including text, graphics, logos, and software, is owned by LuxReset or its licensors and is protected by intellectual property laws. You may view and use the Site for your personal, non-commercial use in connection with the Services. You may not copy, reproduce, distribute, or create derivative works from the Site's content without our prior written consent.

10. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose;
• Submit false information to us, or ask us to submit false information on your behalf to any consumer reporting agency, furnisher, or creditor;
• Attempt to interfere with the security or proper functioning of the Site; or
• Use automated means to access or scrape the Site without our permission.

11. Disclaimers

The Site and any general educational content are provided "as is" for informational purposes and do not constitute legal, financial, or credit counseling advice. Except as expressly stated in your Client Service Agreement, the Services are provided without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Nothing in this section limits any warranty, right, or remedy that cannot lawfully be disclaimed, including rights guaranteed to you under CROA.

12. Limitation of Liability

To the fullest extent permitted by law, LuxReset's total liability arising out of or relating to the Services will not exceed the fees you paid to LuxReset in the twelve (12) months preceding the claim. LuxReset will not be liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be limited under CROA or other applicable consumer protection law, and nothing in these Terms waives any right or remedy CROA provides you.

13. Non-Waiver of Statutory Rights

CROA prohibits any waiver of the protections it provides. No provision of these Terms, and no provision of any agreement between you and LuxReset, waives or limits any right you have under CROA, the Telemarketing Sales Rule, or any other applicable federal or state consumer protection law. If any provision of these Terms conflicts with such a law, the law controls.

14. Governing Law; Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles, except where a different state's consumer protection law applies to you and cannot be waived. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Philadelphia County, Pennsylvania, and you and LuxReset each consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms from time to time. If we do, we will revise the effective date above. Material changes affecting active clients will be communicated in accordance with the notice provisions of your Client Service Agreement.
